In the Sunday edition of the Marshall News Messenger, Todd Fitts, Marshall City Attorney, argued that the Marshall City Commissioners could legally select the Chairman in a secret meeting under the Texas Open Meetings law.
Mr. Fitts did a good job of rationalizing the legality of the Commissioners selecting the Chairman behind closed doors.
For me the real issue is WHY DID THE COMMISSIONERS FEEL THAT THEY NEEDED TO SELECT THE CHAIRMAN IN A MEETING THAT WAS NOT OPEN TO THE PUBLIC?
