The Texas Supreme Court has denied the city of Marshall's request for a rehearing on part of the Caddo Lake water issue lawsuit, which will send the issue back to the Texas Commission on Environmental Quality for re-interpretation, City Attorney Todd Fitts said Saturday.

The ruling came down late Friday and denied a further explanation of factors the court issued in a decision last June. That original decision overturned a TCEQ-issued water use permit on the grounds that the TCEQ did not follow correct procedures on granting Marshall the permit.
