The Court affirms in part the court of appeals' judgment and remands to the Texas Commission on Environmental Quality.

This has been a long running dispute that has been expensive to both sides. It time to put it behind us and move on. Both the City of Marshall and Caddo Lake residents will be better off if they adopt this position.
