Can John Wilborn serve on the MEDCO board and, at the same time run
for the City Commission? The answer is NO but the City Commission is about to “put a fix” to that

Several months ago the Marshall City Commission passed an ordinance that required a member of a city appointed board to resign from that board prior to running for the City Commission.

Sec. 2-9. City appointed boards, commissions, and committees; Prohibiting running for city commission.

A member of any board, commission, or committee shall automatically forfeit his or her appointment for that board, commission, or committee, if he or she becomes a candidate for election to a place on the City Commission. Subject to any conflicting state or federal laws, this shall apply to all city commission appointed boards, commission, or committees.

Clearly the Ordinance prohibits Mr. Wilborn from running for the City Commission while he is on the MEDCO board. But the City Commissioners are going to ensure that he can do both.

Item 7 on the City Commission Meeting for February 9, 2006

Ordinances

Consider approval of an Ordinance amending Chapter 2, Administration of the Code of Ordinances of the City of Marshall by amending Section 2-9 entitled City Boards, Commissions, and Committees; prohibiting running for City Commission and establishing an effective date. (City Manager)

The Commission plans to exempt MEDCO and 4 other boards from this Ordinance.
