With noble purpose, (but mostly MADD pressure), the Texas legislature passed a law intended to further curb driving under the influence. It is the "Open Container Law," which cites the driver when found to have an open container of alcohol in the vehicle. It applies to drivers stopped for any reason, and even applies to innocent passengers--a provision that precludes the naming of a designated drinker. The purpose was based on lessons not learned in the 1920's. Barring alcohol in containers therefore, is actually a mini-resurection of Prohibition, based on the original premise that out-of-sight equals out-of-mind.
